What is the law on collective redundancies?

Collective redundancies occur when a business plans to dismiss as redundant 20 or more employees within a period of 90 days or less. In large-scale redundancy situations, the employer has a legal duty to consult with the affected employees (individual consultation) and their representatives (collective consultation) and also notify the Department for Business, Energy and Industrial Strategy (BEIS).

The collective consultation process for large-scale redundancies is set out by statute and requires the business to:

  • Consult with any recognised trade union or other elected employee representatives
  • Begin the consultation process at least 30 days (where there are between 20 and 99 proposed redundancies) or 45 days (where 100 or more employees are to be made redundant) before the first dismissal
  • Consult on avoiding or reducing the proposed redundancies and how to limit the impact of the dismissals
  • Disclose certain information to the appropriate representatives, including the reasons for the planned redundancies and the selection process for the redundancies
  • Notify BEIS at least 30 or 45 days before the first dismissal

This is a complicated area of law which has significant consequences; failure to follow the procedure can lead to a maximum protective award of up to 90 days’ gross pay for each affected employee.
