Restrictive covenants

Restrictive covenants are clauses written into employment contracts that typically prevent an employee from working for a competing business within a certain period of time after they leave your company. A restrictive covenant may also prohibit an ex-employee from dealing with your customers after they have resigned.

Confidentiality clauses

Confidentiality clauses included in an employment contract provide an extra level of protection against current and former employees disclosing confidential information, including client databases, business plans and financial data, to third parties.

High Court injunction

An injunction can be sought from the High Court to prohibit a former employee from breaching or continuing to breach a restrictive covenant. In deciding whether to grant the injunction, the Court will consider the enforceability of the restrictions, the financial circumstances of the parties and the conduct of those involved.
